Please read these Terms and Conditions carefully before using izebuy.com.

These Terms and Conditions apply to your use of izebuy.com and any related services we provide under the name izebuy. In these Terms, “izebuy,” “we,” “us,” and “our” refer to the operators of the izebuy platform.

By accessing, browsing, registering for, posting on, responding to advertisements on, or otherwise using izebuy, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you must not use izebuy.

These Terms and Conditions apply to all users of izebuy, including advertisers, sellers, buyers, visitors, account holders, and anyone who submits, views, responds to, or relies on advertisements on the website.

A. About izebuy

izebuy is an online advertising and classifieds platform. It allows users to post advertisements for goods and services and allows other users to view and respond to those advertisements.

izebuy provides a platform only. izebuy is not the seller, buyer, owner, agent, broker, employer, lender, guarantor, payment provider, delivery provider, inspector, verifier, or representative of any user.

Any sale, purchase, payment, delivery, refund, return, exchange, agreement, meeting, communication, or transaction is made directly between the buyer and the seller.

izebuy is not a party to any agreement or transaction between users.

izebuy does not own, inspect, verify, test, store, deliver, or guarantee the goods or services advertised on the website. We do not guarantee:

1. that an advertised item or service exists;
2. that an advertisement is true, accurate, complete, current, or lawful;
3. the quality, safety, legality, condition, authenticity, ownership, or suitability of any item or service;
4. the ability of a seller to sell, deliver, refund, or complete a transaction;
5. the ability of a buyer to pay or complete a transaction;
6. that any buyer or seller will act honestly, lawfully, or in good faith;
7. that any transaction will be completed;
8. that any user is who they claim to be.

Users are responsible for making their own checks before contacting another user, making payment, meeting, sending goods, receiving goods, or entering into any transaction.

B. User responsibility and safety

All use of izebuy is at your own risk.

All transactions, communications, meetings, payments, collections, deliveries, refunds, returns, and agreements between users are carried out at the users’ own risk.

izebuy is not responsible for any loss, damage, fraud, scam, dishonest conduct, unlawful conduct, failed transaction, defective item, fake item, non-delivery, non-payment, refund dispute, return dispute, personal injury, or other problem arising from or connected with an advertisement, user, communication, meeting, payment, or transaction.

You are responsible for protecting yourself. In particular:

1. do not pay for goods or services you have not seen or verified;
2. do not send money before you are satisfied that the seller and item are genuine;
3. inspect goods carefully before paying where possible;
4. meet in a safe public place where appropriate;
5. keep records of messages, receipts, payment confirmations, names, phone numbers, addresses, and seller details;
6. be cautious of unrealistic prices, urgent payment requests, guaranteed returns, pressure to pay quickly, requests to move the conversation away from izebuy, or stories designed to rush you;
7. be cautious of users who refuse inspection, refuse reasonable questions, or provide inconsistent information;
8. report suspicious advertisements or users to izebuy where possible.

Any warning, safety notice, moderation action, or platform rule provided by izebuy does not remove your responsibility to make your own checks and protect yourself.

C. Advertisements and user content

You are fully responsible for anything you post, submit, upload, send, display, or communicate through izebuy, including advertisements, descriptions, prices, images, names, phone numbers, addresses, links, messages, and account information.

By submitting content to izebuy, you confirm that:

1. the content is true, accurate, current, and not misleading;
2. you have the legal right to advertise the goods or services;
3. you have the legal right to use any text, images, logos, names, trademarks, or other materials included in your advertisement;
4. the goods or services comply with applicable law;
5. the content does not infringe any person’s copyright, trademark, patent, trade secret, privacy rights, confidentiality rights, or other rights;
6. the content does not contain unlawful, harmful, abusive, fraudulent, obscene, sexually explicit, hateful, discriminatory, threatening, defamatory, or otherwise inappropriate material;
7. the content complies with these Terms and Conditions and any posting rules shown before submission.

You must not submit false, misleading, deceptive, fraudulent, unlawful, harmful, offensive, abusive, threatening, hateful, discriminatory, sexually explicit, defamatory, or inappropriate content.

You must not impersonate another person, business, brand, organisation, public authority, or representative.

You must not use the name, logo, trademark, identity, or branding of izebuy or any other person or business in a way that may mislead users.

D. Prohibited and restricted advertisements

You must not advertise goods, services, content, or activities that are illegal, unsafe, restricted, regulated, misleading, deceptive, abusive, exploitative, or unsuitable for izebuy.

Advertisements must be written in English or Chichewa only.

You must not submit advertisements for:

1. illegal goods, illegal services, or anything that requires a licence, approval, permit, or authorisation that you do not clearly have;
2. violence, threats, abuse, harassment, hate speech, discrimination, or encouragement of harm;
3. sexual, pornographic, adult, exploitative, or child-unsafe content;
4. scams, fraud, deception, impersonation, fake documents, counterfeit currency, misleading offers, or suspicious business opportunities;
5. firearms, weapons, ammunition, explosives, gun parts, weapon parts, weapon accessories, or any product or service connected to weapons or explosives;
6. prescription medicines, pharmaceuticals, controlled substances, narcotics, recreational drugs, or drug-related services;
7. regulated medical goods, including surgical tools, diagnostic equipment, hospital equipment, dental equipment, clinical equipment, or similar professional medical products;
8. crude oil, fuel products, gas, flammable materials, hazardous materials, or related investment opportunities;
9. alcohol, tobacco, nicotine products, or related products;
10. counterfeit goods, replicas, fake branded goods, pirated goods, or anything that infringes copyright, trademark, patent, trade secret, or other intellectual property rights;
11. live animals, endangered species, protected wildlife, animal parts, or products made from endangered or protected species;
12. human organs, human tissue, blood, bodily fluids, or related products or services;
13. dietary supplements, health products, fertility products, sexual-performance products, weight-loss products, or anything making medical, health, cure, treatment, or guaranteed-result claims;
14. financial products, financial services, money services, investment services, trading services, credit services, lending, borrowing, financing, capital raising, money transfer, remittance, currency exchange, payment services, financial advice, wealth-building schemes, digital assets, cryptocurrency, blockchain, Web3, NFTs, tokens, wallets, DeFi, exchanges, or any current or future product, service, software, scheme, training, consulting, marketing, or business activity whose purpose is to provide, obtain, move, store, manage, multiply, invest, trade, borrow, lend, exchange, or facilitate access to money, credit, value, assets, or financial gain;
15. gambling, betting, lotteries, casino services, games of chance, gambling software, betting software, gambling infrastructure, odds systems, betting monetisation, or anything that builds, supports, improves, or enables gambling or chance-based monetisation;
16. work-from-home schemes, get-rich-quick schemes, guaranteed-income schemes, pyramid schemes, referral-money schemes, or similar offers;
17. spiritual, supernatural, occult, mystical, magical, ancestral, faith-based, religious-for-hire, or metaphysical services, including spiritual healing, faith healing, traditional healing, witchcraft, voodoo, spells, rituals, charms, curses, cleansing, paid prayers or blessings, psychic services, divination, prophecy, tarot, astrology, mediumship, curse removal, bad-luck removal, demon removal, tokoloshe removal, love spells, fertility spells, money spells, court-case spells, job spells, exam spells, gambling spells, or promises to solve real-world problems through spiritual, supernatural, mystical, ancestral, magical, or unseen forces;
18. content written in languages other than English or Chichewa;
19. any other product, service, or content that we reasonably consider unsuitable for izebuy.

We assess advertisements by their substance, not only by their wording. Changing the wording, avoiding obvious keywords, using coded language, or describing a prohibited product or service indirectly does not make it allowed.

izebuy may reject, remove, hide, edit, suspend, or delete any advertisement at any time, with or without notice, if we believe it may breach these Terms and Conditions, breach the law, create risk for users, create risk for izebuy, or be unsuitable for the website.

E. Moderation and refusal of advertisements

izebuy is not required to publish any advertisement submitted to the website.

Submitting an advertisement does not guarantee that it will be published.

Publication of an advertisement does not mean that izebuy has verified, approved, endorsed, guaranteed, inspected, or accepted responsibility for the advertised goods, services, seller, buyer, advertiser, or transaction.

We may use manual review, automated review, AI moderation, user reports, internal checks, or any other method to review advertisements, users, and accounts.

Moderation may not detect every unlawful, fraudulent, unsafe, inaccurate, misleading, or prohibited advertisement. You must still make your own checks before dealing with another user.

izebuy reserves the right to reject, refuse, remove, hide, edit, suspend, or delete any advertisement, account, content, or user access at any time, for any reason or no stated reason, with or without notice, even if the advertisement does not appear to breach these Terms and Conditions.

We may reject, delay, remove, hide, edit, suspend, or delete any advertisement at our discretion.

We may suspend, restrict, or terminate access to izebuy if we believe a user has breached these Terms and Conditions, posted prohibited content, misused the website, attempted to avoid moderation, or created risk for other users or for izebuy.

F. Payments for advertisements

Any fees paid to izebuy are payment for advertising services on the platform, subject to these Terms and Conditions.

Unless we state otherwise in writing, advertisement fees are non-refundable once paid.

You should not make payment for an advertisement until izebuy has confirmed that you should proceed with payment.

If your advertisement is rejected, removed, suspended, or deleted because it breaches these Terms and Conditions, breaches the law, creates risk, or is unsuitable for the website, you will not be entitled to a refund.

Payments made between buyers and sellers are not handled, guaranteed, protected, refunded, reversed, or controlled by izebuy unless izebuy expressly states otherwise in writing.

G. Buyer and seller obligations

Sellers are responsible for the goods and services they advertise, including descriptions, images, availability, pricing, ownership, condition, quality, safety, legality, delivery, returns, refunds, warranties, and compliance with applicable laws.

Buyers are responsible for checking advertisements, asking questions, inspecting items, verifying sellers, agreeing terms, making payments safely, collecting or receiving goods, and deciding whether to proceed with a transaction.

Any agreement between a buyer and seller is between those users only.

izebuy is not responsible for enforcing buyer-seller agreements, resolving disputes, collecting payments, arranging delivery, providing refunds, replacing goods, guaranteeing items, or compensating users.

H. Using izebuy

When using izebuy, you must not:

1. interfere with, damage, overload, disrupt, or misuse the website, servers, systems, or services;
2. upload viruses, malware, harmful code, or any technology that may harm izebuy or its users;
3. use robots, scrapers, crawlers, data-mining tools, automated tools, or similar methods to access, copy, collect, or extract data from izebuy without written permission;
4. copy, reproduce, distribute, display, reverse engineer, decompile, disassemble, or create derivative works from izebuy content, systems, or services without permission;
5. breach or bypass any security, technical, moderation, account, or access-control measure;
6. post content in the wrong category or misuse categories;
7. manipulate prices, listings, search results, user feedback, reports, or any website feature;
8. send spam, unsolicited messages, bulk communications, chain letters, or marketing messages to users;
9. collect, store, sell, share, or misuse users’ personal information;
10. use izebuy to harass, threaten, deceive, defraud, or harm another person;
11. transfer, sell, share, or give your account to another person without our consent;
12. use izebuy if you are under 18 or otherwise unable to form legally binding contracts;
13. use izebuy after your account has been suspended, restricted, or terminated;
14. do anything that undermines the safety, integrity, reputation, operation, or purpose of izebuy.

I. Accounts and registration

If you create an account or submit information to izebuy, you must provide true, accurate, current, and complete information.

You are responsible for keeping your login details confidential.

You are responsible for all activity carried out through your account.

You must notify us if you believe your account has been accessed or used without permission.

You confirm that you own or have permission to use any text, images, logos, trademarks, or other materials included in your advertisement.

K. Third-party links and external websites

Advertisements or other content on izebuy may contain links, contact details, references, or directions to third-party websites, apps, payment methods, locations, or services.

izebuy does not control third-party websites, apps, services, payment methods, communications, products, or content.

izebuy is not responsible for any third-party website, app, service, payment method, communication, product, content, loss, damage, fraud, scam, or dispute.

If you leave izebuy or deal with a third party, you do so at your own risk.

L. Privacy and personal information

Your use of izebuy may involve the collection and use of personal information. Our use of personal information is governed by our Privacy Policy, where applicable.

You must not collect, copy, sell, share, publish, or misuse another user’s personal information, including names, phone numbers, email addresses, addresses, account details, or other contact details.

You must not use information found on izebuy to send spam, unsolicited marketing, bulk messages, scams, threats, harassment, or unlawful communications.

M. No warranties

izebuy is provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be available, uninterrupted, secure, error-free, accurate, complete, or up to date.

We do not guarantee that advertisements are genuine, lawful, safe, accurate, complete, available, or suitable for any purpose.

We do not guarantee that users are genuine, honest, reliable, lawful, or able to complete transactions.

To the fullest extent permitted by law, izebuy disclaims all warranties, representations, guarantees, and conditions, whether express, implied, statutory, or otherwise.

N. Limitation of liability

To the fullest extent permitted by law, izebuy and its operators, owners, officers, employees, agents, contractors, and service providers shall not be liable for any loss, damage, claim, cost, expense, injury, fraud, scam, failed transaction, non-payment, non-delivery, defective item, fake item, misleading advertisement, user conduct, or dispute arising from or connected with:

1. your use of izebuy;
2. your inability to use izebuy;
3. any advertisement, message, content, user profile, or user information;
4. any transaction or attempted transaction between users;
5. any meeting, communication, payment, delivery, refund, return, exchange, or agreement between users;
6. any third-party website, app, service, payment method, or link;
7. any moderation decision, delay, rejection, suspension, removal, editing, or deletion of content or accounts;
8. any error, interruption, downtime, security issue, data loss, or technical problem.

Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot be excluded or limited under applicable law.

O. Indemnity

You agree to indemnify and hold harmless izebuy and its operators, owners, officers, employees, agents, contractors, and service providers from and against any claims, losses, damages, liabilities, costs, and expenses arising from or connected with:

1. your use or misuse of izebuy;
2. your advertisement, content, messages, goods, or services;
3. your breach of these Terms and Conditions;
4. your breach of any law or regulation;
5. your infringement of any third-party right;
6. any transaction, dispute, or agreement involving you and another user.

P. Suspension and termination

We may suspend, restrict, or terminate your access to izebuy at any time, with or without notice, if we believe that you have breached these Terms and Conditions, misused the website, created risk for users, created risk for izebuy, or acted unlawfully, dishonestly, or abusively.

You may stop using izebuy at any time.

Sections of these Terms and Conditions that by their nature should continue after termination shall continue to apply, including sections dealing with user responsibility, prohibited content, payments, intellectual property, privacy, warranties, limitation of liability, indemnity, governing law, and disputes.

These Terms and Conditions are governed by the laws of Malawi, unless another applicable law requires otherwise.

izebuy is designed mainly for users in Malawi. However, because the website may be accessible from other countries, you are responsible for complying with any laws and regulations that apply to you based on your location, the location of the goods or services, and the location of the other party to the transaction.

You must not use izebuy where doing so would be unlawful.
